A class-action suit has been filed against the video game giant Electronic Arts pertaining to the drums in the Rock Band game. According to the suit, the bass drum foot pedal falls apart which leaves the game unplayable as marketed. Electronic Arts has sold more than 3.5 million bundled copies of the game, and thousands of the stand alone drum kits, knowing that they were defective and continued to sell them without mentioning the problem, the plantiffs claim.
Monte Morgan, the lead plantiff claims that it comes defective out of the box, and many people buy the game vs. the competitors due to the ability to play the drums. He mentioned that EA offered to repair or replace the pedal past the 60-day warranty, but they revoked that offer as of October 1st, an announcement coming out stating they would no longer make exceptions to the warranty. This announcement came out four days before the announcent of the release date of Rock Band 2(RB 2). According to Electronic Arts, that RB 2 would have improved drum pedals.
The suit includes EA, Harmonix and MTV Networks, and implies unfair competition, violations of consumer law, and breaches of implied warranties. Morgan is suing for damages and restitution, and injunction and attorney fees.
